In any civil claim, including one based on a car accident, the plaintiff, the person filing the claim, must show three elements in order to be successful. He or she must show that there were damages. In a car wreck, this may be property damage or physical injury. The second element is injury causation. The plaintiff has to show that his or her injuries are the result of the accident. Finally, the plaintiff must show liability. This means that they have to show that the person or entity named in the claim did something negligent to either cause the accident, or to make an inevitable accident worse. All three of these elements must be present for a successful claim.
